Terms of Service

These terms govern your use of HealthTracker, an app that helps families coordinate daily care for an elder family member. By creating an account or using the app, you agree to these terms. If you don't agree, please don't use the service.
1. Accepting these terms
By registering for, accessing, or using HealthTracker (the “service”), you agree to these Terms of Service and to our Privacy Policy, which is incorporated here by reference. If you use the service on behalf of your family, you confirm you are authorised to do so.
2. What HealthTracker is
HealthTracker helps a family organise care for an elder relative: daily care routines and tasks, medication and appointment reminders, optional vitals logging, a shared family journal, and alerts to family members. It is a coordination and communication tool. It is not a medical device, a healthcare provider, a pharmacy, or an emergency-response service, and it does not replace professional medical judgement.
3. Eligibility
You must be at least 18 years old to create an account. By adding another person (a “patient”/loved one) to a household, you confirm that you are authorised to enter and manage their information and that you have their consent (or the consent of their authorised representative). The service is not directed to children under 18.
4. Accounts & households
- Members are organised into a household with roles (admin, caretaker, patient). Care data is shared within a household and not across households.
- You are responsible for the activity under your account and for keeping your login credentials secure. Tell us promptly if you suspect unauthorised access.
- Provide accurate information and keep it up to date. We may suspend accounts that appear to be fraudulent or that violate these terms.
5. Acceptable use
You agree not to:
- Use the service unlawfully, or to enter another person's data without authority or consent.
- Attempt to access accounts, households, or data that are not yours, or probe, scan, or breach security.
- Disrupt or overload the service, or interfere with other users.
- Reverse-engineer, resell, or misuse the service or its content except as permitted by law.
- Upload unlawful, harmful, or infringing content.
6. Your content & data
You keep ownership of the information you enter (care routines, notes, readings, journal entries, photos). You grant us a limited licence to store and process that content solely to operate and improve the service for your household, as described in the Privacy Policy. We do not sell your data and do not use health or care data for advertising. You can export or delete your data as set out in the Privacy Policy.
7. Reminders & alerts
Reminders, missed-dose alerts, appointment reminders, refill alerts, and the emergency-SOS feature are provided on a best-effort basis. Delivery depends on networks, devices, and third-party providers (e.g. messaging carriers), and messages may be delayed, duplicated, or fail to arrive. Do not rely on the service as your only safeguard for medication, appointments, or emergencies. Always keep your own arrangements for anything time-critical.
8. Subscriptions & billing
- Free trial: new households start with a 15-day free trial of paid features; no card is required to begin.
- Plans: after the trial you can continue on a free basic plan or subscribe to a paid plan (e.g. Care, Family, Care+), billed monthly or annually. Prices are shown in the app at the time you subscribe.
- Payments: paid plans are processed by third-party payment providers. By subscribing, you authorise the applicable recurring charge until you cancel.
- Renewal & cancellation: subscriptions renew automatically each period unless you cancel. You can cancel anytime; cancellation stops future renewals and you keep paid access until the end of the current period, after which the household moves to the free plan — your data is retained, not deleted.
- Refunds: except where required by law, payments for a completed or in-progress billing period are non-refundable.
- Changes: we may change prices or plan features; we will give reasonable notice, and changes apply from your next renewal.
9. Medical & emergency disclaimer
HealthTracker does not provide medical advice, diagnosis, or treatment, and nothing in the app should be treated as a substitute for professional medical care. Always consult a qualified clinician for medical decisions. The service is not for emergencies: the SOS feature notifies family members on a best-effort basis and is not a substitute for emergency services. In an emergency, contact your local emergency number.
10. Availability & changes
We work to keep the service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend, or discontinue features, and some features may be labelled as beta or early access. We will try to give notice of significant changes where practical.
11. Termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you materially breach these terms, misuse the service, or where required by law. On termination, your data is handled as described in the Privacy Policy.
12. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, HealthTracker and its operator are not liable for indirect, incidental, special, or consequential damages, or for any harm arising from missed, delayed, or failed reminders or alerts, or from reliance on the service for medical or emergency purposes. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under applicable law.
14. Governing law
These terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the competent courts in India, without regard to conflict-of-laws rules.
15. Changes to these terms
We may update these terms from time to time. We will post the updated version here and change the “Last updated” date; material changes will also be notified in-app. Continuing to use the service after a change means you accept the updated terms.
